This is the second time this year that Bungie has won a similar Lawsuit.
Destiny 2 is the highly popular First Person Shooter that was first released back in 2017. Since then it has gained popularity to such an extent that cheaters have been running rife.
Bungie, the game’s developer, reached their limit with cheat sellers and emerged victorious in a recent lawsuit, winning $12 million in damages.
Last year, a lawsuit was filed against Romanian cheat-seller Mihai Claudiu-Florentin, claiming he was behind Destiny 2 cheating software VeteranCheats.
A complaint filed by Bungie alleges copyright infringement, DMCA violations, and Washington Consumer Protection Act violations.
Based on Claudia-Florentin’s $2,000 profit from each sale of VeteranCheats across 5,848 downloads, Bungie sought 11,696,000 in damages. On top of that, attorney fees made up $217,250.70. Accordingly, the full amount granted by the court was $12,059,912.98.
The request has been granted by The Washington Western District Court deeming the studio to have sufficiently proven its claims of copyright infringement and breach of contract, but not of the CPA violation.
The official Court documents state:
“The Court finds that default judgment is appropriately entered in Bungie’s favor as to all but the CPA claim.”
The official verdict then stated:
“The Court finds that damages shall be entered in the amount of (1) $11,696,000 for violations of the DMCA; (2) $146,662.28 for violations of the Copyright Act; and (3) $217,250.70 in attorneys’ fees and in costs. The total award shall be entered in the amount of $12,059,912.98.”
In addition to the damages that must be paid to Bungie, Claudiu-Florentin has been granted a permanent injunction, which prevents him from violating Bungie’s copyright.
This is the second Lawsuit of this nature that Bungie has won this year. The first one was against cheat-seller AimJunkies, where Bungie was awarded $4.3 million.
The company is clearly serious about copyright infringement and outside sources selling cheats.
The above information should make any outside cheat-sellers think twice before offering them for sale for Bungie games or other games.
